A former member of the Federal Election Commission says the Justice Department is neglecting its duty to enforce a law that outlines requirements for verifying voter eligibility.

Today the U.S. Supreme Court overturned a federal appeals court ruling that had ordered Ohio Secretary of State Jennifer Brunner to comply with a federal provision in the Help America Vote Act (HAVA) that requires her to perform data matching between the information on new voter registration forms and other state records. About 200,000 of 666,000 voters who have registered in Ohio since January 1 have driver's license numbers or Social Security numbers on voter registration forms that do not match records in other government databases.

The Supreme Court specifically said it was not expressing an opinion as to whether Brunner was properly implementing HAVA, but decided to toss the case out because no private parties, like the Ohio GOP, can sue to enforce the provision. Hans von Spakovsky is an election law expert at The Heritage Foundation and a former member of the Federal Election Commission.
